Bexar County Judge Nelson Wolff says he believes his son, County Commissioner Kevin Wolff, will get a fair trial following his Sunday arrest for driving while intoxicated (DWI). The Bexar County District attorney will not appoint a special prosecutor.

Judge Wolff says he has not spoken to his son since the commissioner was released from custody Sunday.

“But from the media reports that I’ve seen and heard, he really messed up, and he’ll have to deal with that as he works his way through the judicial system,” the county judge says.

He went on to say the charges don’t affect the commissioner’s job, and he believes the courts will be impartial.

“Judges that will be looking at his case are elected separately, they’re not beholden to the Commissioners Court. The District Attorney is elected separately and of course not beholden to the Commissioners Court so there will be an impartial hearing and justice.”

Nelson Wolff is the countywide elected official on the Bexar County Commissioners Court. Kevin Wolff is the Precinct 3 Commissioner who represents the Northside.

Bexar County District Attorney Nico LaHood says there’s no reason to recuse himself from prosecuting Wolff. Police charged Kevin Wolff with DWI after he allegedly rear-ended two cars at a Whataburger.   Wolff and LaHood have had public disagreements over county contracts.

“If I recuse myself from any case where I disagreed with people I might as well go back to private practice. That’s not really a good standard,” LaHood says. “The Commissioner is going to be treated fairly.  He’s not going to get special treatment, I assure you of that.  And he’s not going to be prosecuted any harsher than anyone else.”

Commissioner Wolff’s court date has been set for August19.. He has not returned several calls from Texas Public Radio for comment.
