Military Proceedings In Bowe Bergdahl Case Halted

A military appeals court has halted the proceedings in the desertion case of Army Sgt. Bowe Bergdahl. 

 
Bergdahl was held captive by the Taliban for five years after leaving his post in Afghanistan. He also is charged with misbehavior before the enemy. The case now is pending what could be a number of appellate procedures.

The trial of Bowe Bergdahl is on indefinite hold, the pre-trial motions halted by the appeals court in Washington.

Bergdahl’s defense attorney Gene Fidell says the ruling was triggered by notice from the prosecution that it wanted to appeal the trial judge’s decision to allow the defense access to classified information.

Fidell expects the government will file a brief with the appeals court, and the court may take some time to decide if it will hear arguments.

"It's a question of the process that the defense has to go through - how many hoops we have to go through, rather than whether we have to get access at all," Fidell said. 

Bergdahl, who is still living in San Antonio, is sscheduled for court-martial at Fort Bragg on Aug. 8, but it remains to be seen whether that date will hold.
