Texas Attorney General Responds to Deceptive Ad

July 8, 2010 · Texas Attorney General Greg Abbott sent a stern letter to Travelers Insurance over a television ad he believes is deceiving potential customers.  The TV commercial showcases a car accident in a comic manner as it pitches supplemental liability insurance.

From the TV commercial: “Make sure you’re properly covered.  So when you’re driving your car, you’re not risking your house.”

It’s that last line of the commercial that Abbott takes issue with.  Tom Kelly is spokesman for the Texas Attorney General’s Office.

“In short, it tries to tell Texas homeowners that the auto insurance they currently have may not be sufficient in case they have uncovered liability that could cause them to lose their homes,” said Kelly.

Attorney General Abbott sent a cease and desist letter to The Travelers Companies instructing them to pull the ad, calling it deceptive.  The Texas Homestead Law already protects homeowners from similar scenarios and extra liability insurance is often not required.  Kelly hopes the ad is pulled from television airwaves soon.

“General Abbott’s language in that letter is pretty clear and we put it up on our website as well.  And they should, and we believe they will respond very promptly and let us know what they plan to do,” said Kelly.

Kelly says Abbott’s office will consider further legal action if the Travelers Companies does not respond to the letter.
