Air Force Nurse Accused of Murder Puts Off Entering Plea

An Air Force nurse charged with killing three terminally ill patients has put off entering a plea. Texas Public Radio’s Terry Gildea has more.

September 2, 2009 · Captain Michael Fontana sat in a courtroom Tuesday morning at Lackland Air Force base while his attorneys requested a complete psychological evaluation of their client. 

Fontana’s defense team told the judge there could be “a myriad of mental health issues,” but they added they would not seek an insanity defense.

The prosecution claims there is no evidence that Fontana has mental problems, but the judge granted the defense’s motion for a psychological evaluation.

He also allowed granted defense motions that would allow testimony from a toxicologist and have potential jurors answer a detailed questionnaire. 

Captain Fontana is accused of murdering three terminally ill patients by administering excessive doses of medication while working as a nurse at Wilford Hall Medical Center. 

He will face three murder charges at his Court Martial beginning November 16.  If convicted, Fontana could be sentenced to life in prison.
